Buna g\u00f6re; bo\u015fanma y\u00fcz\u00fcnden yoksullu\u011fa d\u00fc\u015fecek taraf kusuru daha a\u011f\u0131r olmamak ko\u015fuluyla ge\u00e7imi i\u00e7in di\u011fer taraftan mali g\u00fcc\u00fc oran\u0131nda s\u00fcresiz olarak nafaka isteyebilir. 176. maddeye g\u00f6re de nafaka ayl\u0131klar halinde \u00f6denebilece\u011fi gibi nafakan\u0131n toptan \u00f6denmesine karar verilebilir. Mahkemece h\u00fckmedilen yoksulluk nafakas\u0131, nafaka alacakl\u0131s\u0131n\u0131n yeniden evlenmesi veya taraflar\u0131n birisinin \u00f6lmesiyle kendili\u011finden, nafaka alacakl\u0131s\u0131n\u0131n evlenme olmaks\u0131z\u0131n fiilen evliymi\u015f gibi birisiyle ya\u015famas\u0131, yoksullu\u011fun ortadan kalkmas\u0131 ya da haysiyetsiz hayat s\u00fcrmesi halinde mahkeme karar\u0131yla ortadan kalkar. Daha sonra de\u011fi\u015fen duruma g\u00f6re nafakan\u0131n azalt\u0131lmas\u0131 veya art\u0131r\u0131lmas\u0131 da m\u00fcmk\u00fcn.<\/p>\n\n\n\n<p>\u0130\u015fin yasal boyutu b\u00f6yle, yani sonsuza kadar nafaka \u00f6denecek diye bir \u015fey yok asl\u0131nda. Halin icab\u0131na g\u00f6re mahkeme her zaman yoksulluk nafakas\u0131yla ilgili bir karar verebilir. Ayr\u0131ca yasa nafaka konusunda cinsiyet ayr\u0131m\u0131 da yapmam\u0131\u015ft\u0131r, ama hepimiz biliyoruz ki kald\u0131r\u0131lmak istenen nafaka kad\u0131n\u0131n nafakas\u0131d\u0131r.<\/p>\n\n\n\n<p>Burada as\u0131l durup d\u00fc\u015f\u00fcn\u00fclmesi gereken i\u015fin sosyal ve siyasal boyutudur. \u0130lk olarak s\u00f6ylemek gerekir ki kad\u0131n\u0131n \u00e7al\u0131\u015fma hayat\u0131ndan \u00e7\u0131kar\u0131lmas\u0131na \u00e7al\u0131\u015f\u0131ld\u0131\u011f\u0131, evde \u00fct\u00fc, temizlik, yemek yapan, \u00e7ocuklar\u0131na bakan, kocas\u0131n\u0131n aya\u011f\u0131n\u0131 y\u0131kayan bir rol model haline getirildi\u011fi bir d\u00f6nemde bu de\u011fi\u015fikliklerin dillendirilip, yarg\u0131 reformu kapsam\u0131nda iyi bir \u015feymi\u015f gibi sunulmas\u0131 manidard\u0131r. \u0130ktidar\u0131n yapmak istedi\u011fi \u015fey, yanl\u0131\u015fl\u0131kla, zaman\u0131n ruhuna yenik d\u00fc\u015ferek, ilk olarak imzalad\u0131\u011f\u0131 \u0130stanbul S\u00f6zle\u015fmesini bir \u015fekilde bertaraf etmek, kad\u0131n\u0131 ikincil yurtta\u015f stat\u00fcs\u00fcne itmek.<\/p>\n\n\n\n<p>Konunun daha iyi anla\u015f\u0131lmas\u0131 i\u00e7in yoksulluk nafakas\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 iste\u011fini, \u00e7ocuk evliliklerine olanak sa\u011flanmas\u0131 ve istismarc\u0131lar\u0131n \u00f6rt\u00fcl\u00fc olarak affedilmesi sonucunu do\u011furacak \u015fekilde ma\u011fdurun tecav\u00fczc\u00fcs\u00fcyle evlenmesi d\u00fczenlemesiyle birlikte de\u011ferlendirmek gerekir. Netice itibariyle yasalar politik bir tercih oldu\u011funa g\u00f6re yoksulluk nafakas\u0131n\u0131n kald\u0131r\u0131lmas\u0131 veya s\u00fcreye ba\u011flanmas\u0131 da politik bir tercihtir. Tercih edilen de ya\u015fam\u0131n daha muhafazakar bir yap\u0131ya kavu\u015fturulmas\u0131 i\u00e7in kad\u0131nlar\u0131n bo\u015fanma d\u00fc\u015f\u00fcncelerinin yok edilmesidir.&nbsp;<\/p>\n\n\n\n<p>Sosyal devlet ilkesinin sadakac\u0131 devlete evrildi\u011fi bir zamanda, i\u015fsizlik oran\u0131 bu kadar fazla iken nafakan\u0131n s\u00fcreye ba\u011flanmas\u0131 iste\u011fi an\u0131lan politik tercihin konusudur. Kad\u0131nlar\u0131n merdiven alt\u0131 at\u00f6lyelerde sosyal g\u00fcvenceden yoksun olarak \u00e7al\u0131\u015fmaya zorlanmas\u0131d\u0131r. Kad\u0131n eme\u011finin en kolay s\u00f6m\u00fcr\u00fclen emek olarak d\u00fc\u015f\u00fcn\u00fclmesinin bir sonucudur.<\/p>\n\n\n\n<p>Birlikte d\u00fc\u015f\u00fcn\u00fclmesi gereken ba\u015fka bir \u015feyde tecav\u00fczlerin, istismarlar\u0131n konu\u015fulmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7ilmesi, gizli tutulma arzusudur. Ya da de\u011finmek istedi\u011fimiz konular\u0131n hepsi gerici ve \u0130slamc\u0131 ideolojinin \u00fcr\u00fcn\u00fcd\u00fcr. Bu nedenle hep beraber d\u00fc\u015f\u00fcn\u00fcl\u00fcp de\u011ferlendirilmesinde zorunluluk vard\u0131r. Bir erke\u011fin s\u00fcrekli gidip geldi\u011fi yerlerde ayr\u0131 ayr\u0131 kar\u0131lar\u0131n\u0131n olmas\u0131n\u0131n normalle\u015ftirilmeye \u00e7al\u0131\u015f\u0131ld\u0131\u011f\u0131, \u00e7ocuklar\u0131n 9 ya\u015f\u0131nda evlenebilecekleri fetvalar\u0131n\u0131n verildi\u011fi, laiklik ilkesinin yok edilmesine tevess\u00fcl edildi\u011fi ve eylemli olarak ba\u015far\u0131ld\u0131\u011f\u0131, hen\u00fcz idrak \u00e7a\u011f\u0131nda dahi olmayan ilkokul \u00f6\u011frencilerinin toplu namazlara g\u00f6t\u00fcr\u00fcld\u00fc\u011f\u00fc, milli e\u011fitim m\u00fcd\u00fcrl\u00fcklerinin tarikatlarla, m\u00fcft\u00fcl\u00fcklerle ortak dini e\u011fitim protokolleri yapt\u0131\u011f\u0131 bir \u00fclkede \u00f6zellikle kad\u0131nlar\u0131n nafakalar\u0131n\u0131n kald\u0131r\u0131lmaya ya da s\u0131n\u0131rland\u0131r\u0131lmaya \u00e7al\u0131\u015f\u0131lmas\u0131n\u0131n ba\u015fka bir izah\u0131 olamaz. Bir daha s\u00f6ylemek gerekirse politiktir, ideolojiktir.<\/p>\n\n\n\n<p>Hele 3.
